A brief synopsis. 

Topic: The Sefer Torahs of  Moshe, Ezra and the עזרה. In the עזרה or קודש הקדשים. 

A- ספר תורה של משה 

1- Moshe Rabeinu wrote 13 Torahs and distributed them to all 12 tribes and one to Levi. 

The  13th one was placed next to the לוחות. Either inside the ארון itself or on aN external shelf that was attached to the ארון. 

2- Rashi says that this ס”ת was used for public reading on: הקהל  and every Yom Kippur by the כהן גדול. Tosfos says that we don’t find any mention of the כהן גדול entering the קודש הקדשים to bring out and returning this ספר תורה. 

3- Discussed if משה רבינו  was allowed to enter the קודש הקדשים. 

ב״ב יד, ב. אמר ר׳ אחא בן יעקב ספר עזרה לתחלתו הוא נגלל. בדק”ס שעשה משה. 

רש״י שם: ספר שכתב משה ובו קורין בעזרה פרשת המלך בהקהל וכ״ג ביום הכיפורים. 

בב”ר- הכ”ג הי’ מוציאו ביוה”כ? תוס’ ב”ב שם בע”א כותבין שלא אשכחן בסדר העבודה. 

אחרים כותבים שכן. ראשית ביכורים. שהרי סדר העבודה הוא ממה שהי’ בב”ש! וברור שלא הי’ ס”ת בק”ק. ולכן לא נזכר בסדר עבודה. אבל בב”ר, הכה”ג יצא אתו אחרי עבודת הקטורת ומחזירה כשחזר להוציא המחתה!

 וזה כוונת רש”י. עבודת ישראל. 

האם הי’ משה נכנס לקד”ק ?]

תו”כ ,אחיך בבל יבא ואין משה בבל יבא’. ראב”ד: שמשה הי’ נכנס תמיד. צפע”נ: ח”ו!] 

 

B- Uniqueness of Moshe’s ספר תורה

Moshe Rabeinu’s torah.  Ragatchover: This unique Torah (the 13th) was different from the other 12. Moshe wrote into this one the קרי וכתיב , נקודות and the ‘trop’ (cantillation)!!

צפע”נ.  כל המסורה. קרי וכתיב. טעמים (ןלכן נתנה ללויים העומדים על השיר) ונקודות, שם ד’ אותיות!  נגנז בארון, ולכן מותר הי’ לכתבו

וממנו נכתב ס”ת של שאול דוד ושלמה. אחרי בנין הבית שוב לא היו יכולים ליכנס לק”ק.  והמלכים שלאח”ז העתיקו ממלך שלפניו. 

C- What happened to this ס”ת? 

Gemore in Yuma lists all the items that were hidden in caves during the time of  בית ראשון .  

משה רבינו’s ספר תורה us not listed. Perhaps it’s included in the ארון that was hidden. From Rashi above it seems that it still existed in בית שני.

D- ספר תורה של עזרא או עזרה?

Mishna says that ‘on חול המועד one may not repair/correct a letter in any Sefer Torah. Even the one in the עזרה.’ 

Rashi has two explanations. 

1- There was a ספר תורה in the עזרה (azarah) of the בית המקדש. 

2- The word is not עזרה (courtyard) but עזרא (Ezra). Meaning the Sefer Torah written by Ezra! This תורה was used as a ‘master’ for all other ספרי תורה. 

מו”ק יח, ב. אין כותבין סת”ם במועד ואין מגיהין אות אחת אפילו בספר עזרא. 

רש”י 

אפילו בספר .ספר תורה של עזרא. ואני שמעתי עזרה בה’. פירוש ספר מוגה שהי’ בעזרה שממנו מגיהין כל ספרי גולה.

E- Yerushalmi – Establishing the correct way to write all ספרי תורה

There were more than one version to ספרי תורה . This was a result of  גלות בבל. 

They were called ספר מעוני , ספר זעטוטי ,ספר היא. These were words that were different in some ספרי תורה. They [Ezra or others] established for posterity the proper way to write all ספרי תורהs. 

They used the rule אחרי רבים להטות. If 2 Torahs had one version and one had a different one they ruled that we establish the Halachah like the 2. 

Henceforth, all תורהs written differently are פסול!

F- What happened to Ezra’s ספר תורה? 

Fascinating story of Reb Ovadia Bartenura. See below from the Chida’s שם הגדולים.  

He relates that when he was in Egypt he heard that the ספר תורה of Ezra that was in a particular shul was removed by the Shamash who was bribed by an Arab. The Arab took it with him on a boat. Unfortunately, the boat sank…..

On the other hand, the Chida continues, there is a different story printed in a footnote of a Chumash printed in Amsterdam. The story goes that the Rambam heard that this Chumash, written by Ezra himself, was at that time in Burgundy, France. He traveled there and copied it. The day he returned from Burgundy was the 28th of אייר, and he celebrated it every year. 

So it seems that Ezra’s Torah survived until the time of the Rambam!

The previous Rebbe writes in Hayom Yom ז אלול the following:

In Prague there is a Torah scroll which – according to local tradition – had been examined and emended by Ezra the Scribe. It is read only on Simchat Torah and is always rolled to the portion of sh’ma. When I was in Prague in 5668 (1908) I saw that scroll, and in it daka is spelled with an alef.

We briefly discussed the controversy surrounding the author and his books. 

The sharp rebuke from the מהר”ל מפראג. See below a sampling of the מהר”ל’s attack on the book. 

The Beis din of Tzefas. צפת . The proclamation publicizing the חרם urged the Reb Yoseph Karo. See below for a photo of the famed proclamation. 

We spoke that despite his excommunication, he is quoted by some פוסקים!!!!

We mention the מגן אברהם concerning the מי שברך  that was/is said in many Shuls requesting a blessing for the king/czar. The מגן אברהם writes that one should not ask ‘for the king’s enemies to be defeated. The reason is since there are Jews in the neighboring countries that are at odds with this king. So asking for success in their own  king means misery for Jews in other countries, The source of this ruling…..the מאור עינים !!

The Rebbe quotes him with a disclaimer. 

האם חתם הב”י על הח’? מחזיק ברכה שז. 

וכן עוד אחרונים. מג”א רפ”ד, ז. מי שעסקין בצ”מ באמונה. לא לומר ויפיל שונאיו. כי ישנם אחב”י במלכות האחרת. אדה”ז לא מביאו.

אי אפשר בימינו לקיים מצוות כתיבת ספר תורה כדינה, ועל כל פנים מדאורייתא. ובזה מחזקים את פסק הרא”ש (הלכות ס”ת, א) שמצות הכתיבה בזמננו היא של ספרי התורה שבע”פ. 

מהר”ל:

הברייתא על ‘שלושת הספרים בעזרה’  

 

א. מעונה אלהי קדם (דברים לג כז). שלשה ספרים נמצאו בעזרה – אחד

1 של מעונים, ואחד של ‘היא היא’, ואחד נקרא ‘ספר זעטוטים’.

2 באחד כתיב ‘מעון אלהי קדם’, ובשנים כתיב ‘מעונה אלהי קדם’,

3  בטלו חכמים את האחד וקיימו את השנים.

4  באחד כתיב תשעה ‘היא’, ובשנים כתיב אחת עשרה ‘היא’, בטלו

5 חכמים את האחד וקיימו את השנים.

6  באחד כתיב ‘וישלח את זעטוטי בני ישראל, ואל זעטוטי בני ישראל’

7  ובשנים כתיב ‘וישלח את נערי בני ישראל, ואל אצילי בני ישראל’

8  בטלו חכמים את האחד וקיימו את השנים.
